COLOR RUSH — TERMS AND CONDITIONS OF USE

1. ACCEPTANCE OF TERMS

By accessing, registering, or using the Color Rush platform, including all its services, features, and products, you declare that you have read, understood, and fully agree to these Terms and Conditions of Use. If you do not agree with any provision contained herein, do not use the platform.

These terms constitute a binding agreement between you (hereinafter "User") and Color Rush (hereinafter "Platform"). Continued use of the platform after any update to these terms implies automatic acceptance of the changes.

2. DEFINITIONS

Platform: refers to the Color Rush system, accessible via website and applications, including all digital yield services, games (PvP), unilevel network, and associated features.

Yield: the platform's digital yield module in which the User deposits a value into an investment group and receives a percentage return after a determined period (cycle in days).

Yield Group: an operational unit where multiple Users participate simultaneously, each with their own individual yield timer.

Tier: the entry value range available for joining Yield groups (e.g., $3, $5, $10, $25, $50, $75, $100).

Payout: the value automatically credited to the User's wallet at the end of the yield cycle, corresponding to the entry value plus the configured yield percentage.

Unilevel Network: a multi-level bonus system where Users receive percentages on the profits of direct and indirect referrals, limited to 20 levels of depth.

Wallet: the User's internal virtual account on the platform, used for deposits, withdrawals, investments, and receipts.

Subscription Plan: the access level (Free, Basic, Pro, VIP) that determines how many groups the User can participate in simultaneously.

3. ELIGIBILITY AND REGISTRATION

To use the Color Rush platform, the User must meet the following requirements:

a) Be at least 18 (eighteen) years of age or the legal age of majority in their jurisdiction.

b) Provide true, complete, and up-to-date information during registration.

c) Have the legal capacity to enter into binding contracts.

d) Not be prohibited by any applicable law from using services of this nature.

e) Maintain the confidentiality of their access credentials (login and password).

The User is fully responsible for all activity carried out on their account. In case of unauthorized access, the User must notify the platform immediately.

4. DESCRIPTION OF SERVICES

4.1 Yield (Digital Returns)

The Yield module allows the User to join digital yield groups by depositing a value corresponding to the chosen Tier. Upon entering a group, the yield timer starts immediately. After the configured cycle period (in days), the User automatically receives in their wallet the invested amount plus the yield percentage.

Yield percentages, cycle durations, and entry values are defined by the platform administration and may be changed at any time, provided that changes do not affect investments already in progress.

4.2 Entry Fee

When joining a Yield group, an entry fee is charged (currently 7% of the Tier value). This fee is composed of a portion allocated to the group's financial cushion (pool) and another portion as platform revenue. The fee is disclosed to the User before confirming their participation.

4.3 Unilevel Network (Referral Bonus)

Users who refer new members may receive bonuses on the profit generated by their referrals when they complete yield cycles. The system has up to 20 levels of depth, each with a percentage and minimum qualifying volume defined by the administration.

The bonus is calculated exclusively on the referral's net profit (difference between payout and entry value), never on the total invested amount. Receiving bonuses at each level is conditional on the referring User's minimum active volume in Yield groups.

4.4 PvP Games (Color Rush)

The platform offers competitive games (Player vs Player) where Users compete against each other in rounds with specific mechanics. The rules, prizes, and mechanics of each PvP mode are defined by the platform and may be updated periodically.

4.5 Native Token (Future)

Color Rush plans the development and launch of a native digital token for the platform. The terms, conditions, utility, and specific regulations of the token will be communicated in an addendum to these Terms when applicable. No information contained herein constitutes a promise, guarantee, or offering of securities.

5. DIGITAL WALLET AND FINANCIAL TRANSACTIONS

5.1 Deposits

Deposits are made through the available payment methods on the platform, including local payment solutions and cryptocurrencies. Deposited values are converted to the platform's internal currency (USD) and credited to the User's wallet after payment confirmation by the gateway.

5.2 Withdrawals

Withdrawals are subject to a processing fee of 7% on the requested amount. The minimum withdrawal amount is $10.00 (ten dollars). Withdrawals are processed upon administrative approval and may take up to 48 (forty-eight) business hours to be completed.

The platform reserves the right to request identity verification before processing withdrawals, in accordance with its security and compliance policies.

5.3 Transfers

Transfers between platform Users are permitted, subject to a minimum value of $0.50 (fifty cents). Self-transfers are not allowed. Transfers are processed instantly and carry no fee.

6. SUBSCRIPTION PLANS

The platform offers subscription plans that determine the maximum number of Yield groups in which the User can participate simultaneously. Available plans and their benefits are presented in the corresponding section of the platform.

Subscriptions have a defined validity period. Upon expiration, the User automatically returns to the free plan. Groups in progress at the time of plan expiration are not affected and continue until the normal completion of the cycle.

7. REFUND AND EXIT POLICY

The User may request to leave a Yield group and receive a full refund (entry value + fee) provided their individual yield timer has not yet expired. After the timer expires, the system automatically processes the payout and refund is no longer applicable.

Deposits made via payment gateway are not directly refundable. For disputes, the User should contact the platform's support team.

8. RISK DISCLOSURE

The User acknowledges and accepts that:

• Digital yield investments involve inherent risks, including but not limited to the possibility of partial or total loss of invested capital.

• Past returns do not constitute a guarantee of future results.

• The platform is not a regulated financial institution and does not offer government guarantees on deposits or investments.

• Market conditions, technical and operational factors may affect the availability and returns of services.

• The User should only invest amounts they can afford to lose without compromising their basic financial needs.

9. PROHIBITED CONDUCT

The following is expressly prohibited:

• Using multiple accounts to circumvent plan limits or obtain undue advantages.

• Reverse engineering, hacking, exploiting vulnerabilities, or interfering with the platform's operation.

• Using bots, automated scripts, or any form of unauthorized automation.

• Using the platform for money laundering, financing illegal activities, or any illicit activity.

• Making misleading claims about guaranteed returns or fixed income promises when referring new users.

• Violating the platform's intellectual property rights, including brand, code, and design.

Violation of any prohibited conduct may result in suspension or permanent banning of the account, with possible withholding of funds, without prejudice to applicable legal measures.

10. INTELLECTUAL PROPERTY

All content on the Color Rush platform, including but not limited to: source code, visual design, trademarks, logos, text, graphics, animations, game mechanics, and algorithms, are the exclusive property of Color Rush and are protected by applicable intellectual property legislation.

The User receives a limited, non-exclusive, non-transferable, and revocable license to use the platform in accordance with these Terms. No intellectual property rights are transferred to the User.

11. LIMITATION OF LIABILITY

The platform is provided "as is." To the maximum extent permitted by law, Color Rush makes no express or implied warranties regarding:

• Uninterrupted or error-free availability of the platform.

• Specific financial results or guaranteed returns.

• Suitability of services for the User's specific purposes.

• Absolute security against cyberattacks or third-party failures (gateways, blockchain, etc.).

Color Rush is not liable for financial losses resulting from the User's investment decisions, third-party service failures, acts of God, or force majeure.

12. MAINTENANCE, UPDATES, AND SUSPENSION

The platform may perform scheduled or emergency maintenance that results in temporary unavailability of services. For scheduled maintenance, Users will be notified in advance whenever possible.

Color Rush reserves the right to, at any time and without prior notice, modify, suspend, or discontinue any feature or service, including yield percentages, available tiers, and game mechanics.

Yield timers in progress during maintenance periods may have their deadlines adjusted to ensure fairness to affected Users.

13. PRIVACY AND DATA PROTECTION

The collection, storage, and processing of User personal data are governed by Color Rush's Privacy Policy, a complementary document to these Terms. By using the platform, the User consents to the processing of their data as described in said policy.

The platform employs technical and organizational measures to protect User data against unauthorized access, loss, or destruction, in accordance with information security best practices.

14. COMMUNICATIONS AND NOTIFICATIONS

The platform may send communications to the User through internal platform notifications, registered email, or on-screen notices (Warning system). The User agrees to receive such communications as an essential part of service operation.

15. CHANGES TO TERMS

Color Rush reserves the right to change these Terms at any time. Changes take effect on the date of their publication on the platform. Continued use of the services after publication of changes constitutes acceptance of the new terms.

Material changes that significantly affect User rights will be prominently communicated on the platform.

16. GENERAL PROVISIONS

Entirety: These Terms, together with the Privacy Policy, constitute the entire agreement between the User and Color Rush.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: Failure by Color Rush to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

Assignment: The User may not assign or transfer their rights under these Terms without prior written consent from Color Rush.

17. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the jurisdiction in which Color Rush operates. Any dispute arising from these Terms shall be submitted to mediation as a first resort, and failing agreement, to the competent court of the company's headquarters.
